[조홍균의 금융경제 읽기] 인센티브 설계로 풀어나가야 할 검찰 개혁

2026년 10월 1일 서울의 어느 지방검찰청을 방문했다. 다음 날부터 시행되는 검찰 개혁을 앞두고 지방검찰청 현판이 지방공소청으로 교체되는 순간을 한 언론사가 취재하고 있었다. 오후에는 검찰 전산망을 전면 교체하는 작업도 시작되었다. 검찰 구성원들의 표정에는 착잡함이 역력했다. 1948년 창설된 검찰의 78년 역사에 큰 획을 긋는 순간임이 분명했다. 바로 옆 법원 사람들의 표정 역시 결코 밝아 보이지 않았다. 애덤 스미스가 말한 상상에서의 역지사지(imaginary change of situation)는 인간에게 내재한 공감(sympathy)의 능력일까.

'정의는 사회라는 거대한 구축물을 지지하는 주된 기둥이다. 만일 이 기둥이 제거된다면 전 인간사회는 순식간에 잿더미로 화할 것이다.' 애덤 스미스가 도덕감정론에서 한 말이다. 현판이 교체되는 것이, 전산망이 교체되는 것이 어느 조직의 변화에 그치지 않고 사회라는 구축물을 지탱하는 기둥의 변화가 되어서는 안 된다는 생각이 들었다. 인간의 마음속에 존재하는 가상의 공평한 관찰자(supposed impartial spectator)와 그가 만들어내는 공감의 질서 원리가 문득 떠올랐다. 마침 필자가 지난달 박사과정 종합시험(논문제출자격시험)에 출제한 문제의 일부가 애덤 스미스의 도덕감정론이었기 때문일까.

돌이켜보면 지난 78년 동안 검찰은 광범위한 범죄 수사와 기소 권한을 행사하면서 한편으로는 두려움과 비판의 대상이었지만 다른 한편으로는 사회적 평가와 존중의 대상이었다고 할 수 있다. 한국에서 검찰이 지닌 세간의 명성은 일면 문화적인 것이기도 했다. 검사가 된다는 것은 부모에게 기쁨을 주는 일이었을 뿐만 아니라 권력을 가진 직업을 얻는 동시에 국가가 인정하는 엘리트(state-certified elite)가 된다는 의미이기도 했다.

이제 숱한 논란 속에서 검찰은 수사와 기소 기능을 분리하는 새로운 체제로 들어섰다. 이는 그동안 검찰이 수사와 기소를 독점함으로써 정적을 탄압하고 제거하기 위한 정치적 목적의 기소를 해왔다고 주장해 온 강경 개혁파의 승리라고 평가할 수도 있다.

그러나 다른 한편에서는 금융 범죄(financial crime)를 비롯한 여러 민생 분야에서 법치의 공백이 발생할 수 있다는 우려도 제기된다. 특히 여의도의 저승사자로 불리던 서울남부지방검찰청의 금융증권 범죄 전담 조직이 해체되면서 이러한 우려는 더욱 현실적인 문제가 된다. 이를 대체할 새로운 수사기관이 이른바 화이트칼라 범죄에 대한 전문성과 노하우를 축적하기까지는 상당한 시간이 필요할 수 있다.

금융 범죄 수사는 일반적인 범죄 수사와 다르다. 복잡한 금융거래의 구조를 이해해야 하고 자본시장과 기업의 의사결정 과정을 읽어야 하며 새로운 금융상품과 금융거래기법이 등장할 때마다 수사기법도 진화해야 한다. 전문성과 경험이 축적되지 않으면 법률상 권한만으로는 효과적인 법집행을 보장하기 어렵다.

뉴욕이 세계 금융의 중심지로 발전하는 과정에서도 금융 범죄에 대한 확고한 법집행은 중요한 역할을 했다. 1942년 5월 22일자 뉴욕타임스에 제정 소식이 보도될 정도로 주목받은 Rule 10b-5 등의 규제 타깃인 내부자거래(insider trading)를 비롯한 고도의 금융 범죄를 특히 뉴욕 맨해튼지검과 남부지검은 지속적으로 수사하고 기소하면서 금융시장의 투명성과 법적 예측 가능성을 높이는 데 기여했다. 수십 년에 걸쳐 금융 범죄를 뛰어난 수사역량과 법집행 의지로 척결함으로써 뉴욕 금융시장의 투명성과 안정성이 크게 제고되고 세계 최고 수준의 굳건한 신뢰를 구축하기에 이른다. 오늘날 뉴욕 금융시장으로 전 세계에서 투자자본과 금융전문인력이 몰려드는 이유다.

금융 발전을 위해 필요한 요소들이 많지만 그 핵심 요소의 하나이자 필수불가결한 요소는 금융에 있어 법의 지배(rule of law)를 확고히 하는 것이다. 금융의 본질은 신뢰이며 그 신뢰의 토대는 법의 지배에서 비롯되고 만들어지기 때문이다. 투자자는 높은 수익률만을 보고 시장에 들어오지 않는다. 계약이 지켜질 것인지, 사기와 내부자거래가 적발될 것인지, 불공정거래가 처벌될 것인지, 그리고 법이 특정한 사람이나 집단에게 선택적으로 적용되지 않을 것인지를 함께 본다. 금융시장의 경쟁력은 금융제도와 금융상품만으로 결정되는 것이 아니라 법집행의 신뢰성에 의해서도 결정된다. 한국이 아시아의 금융 중심지로 도약하겠다는 목표를 아직 달성하지 못하고 있는 상황에서 금융 분야 법의 지배 강화는 더욱 중요하다.

그렇다면 정치적 목적의 기소를 비판하며 수사와 기소를 분리한 이번 검찰 개혁 이후 금융 범죄를 비롯한 여러 민생 분야에서 법치의 공백이 발생할 수 있다는 일각의 우려를 어떻게 해소할 것인가.

필자는 그 답을 법경제학적 인센티브 구조 설계에서 찾아야 한다고 생각한다. 수사기관과 기소기관이 분리되었다면 앞으로 중요한 것은 각 기관이 얼마나 잘 협력하도록 제도를 설계하느냐이다. 협력하라고 요구하는 것만으로는 충분하지 않다. 협력의 필요성을 강조하는 것과 실제로 협력이 일어나도록 만드는 것은 전혀 다른 문제이기 때문이다.

여기서 긴요한 것은 단순한 협의나 조율을 넘어서는 인센티브 정합적인 거버넌스 개혁이다. 수사기관과 기소기관 사이에는 필연적으로 새로운 여명지대(zone of twilight)가 형성될 수밖에 없다. 어느 기관이 어디까지 책임져야 하는지, 사건의 우선순위를 누가 정할 것인지, 수사 과정에서 확보한 정보를 어떻게 공유할 것인지, 기소 판단의 실패가 발생했을 때 그 책임은 누구에게 귀속되는지 등 수많은 경계 문제가 발생할 것이다.

이때 요구되는 것은 협력 목표, 협력 성과지표, 협력 책임구조, 그리고 실패를 학습으로 전환하는 제도적 프레임워크를 함께 설계하는 일이다. 기관 간 협력이 부족한 경우 대체로 그 이유는 의지가 없기 때문이 아니다. 오히려 협력해도 각 기관에 돌아오는 보상이 작고 실패하면 책임만 커지며 성공하더라도 그 성과가 각 기관의 평가와 인사에 제대로 반영되지 않는다면 합리적인 조직은 협력하지 않을 유인을 갖게 된다.

따라서 협력을 개인의 선의(good faith)에만 맡겨서는 안 된다. 협력 과정이 각 기관의 성과 평가에 반영되도록 하고 수사와 기소의 성과가 인사와 보상 체계에 연결되도록 해야 한다. 반대로 실패가 발생했을 때에는 결과만을 보고 책임을 묻는 것이 아니라 각 기관의 통제 가능성과 의사결정 과정에 따라 책임을 합리적으로 배분해야 한다. 특히 중요한 것은 실패를 학습으로 전환하는 장치다. 새로운 제도가 도입된 후에는 예상하지 못했던 실패가 나타날 수도 있다. 관건은 그 실패가 다음 성공을 위한 정보로 어떻게 활용되느냐이다.

이런 관점에서 검찰 개혁은 법 형식주의(legal formalism)만으로 접근해서는 충분하지 않다. 법이 실제 사회에서 어떻게 작동하는가를 중시하는 법 현실주의(legal realism)의 관점과 법경제학적 사고가 함께 필요하다. 기관 명칭 변경이나 권한 분리에서 머무는 것이 아니라 실제 행위자들이 어떤 유인을 지니고 행동하는지를 분석해야 한다. 법은 종이에 쓰인 규칙이 아니라 행위자들의 행동을 통해 구현되며 법의 지배는 법의 존재만으로 완성되는 것이 아니라 그 법을 집행하는 사람들의 행동과 유인구조를 통해 현실 속에서 이루어진다.

좋은 제도란 좋은 사람을 전제로 하는 제도가 아니다. 서로 다른 이해관계와 조직의 유인을 고려하더라도 사회적으로 바람직한 성과가 나오도록 만드는 제도다. 이번 검찰 개혁은 제도를 일거에 바꾸는 것으로 끝나는 것이 아니라 그 이후가 오히려 중요하다. 수사기관과 기소기관이 서로 경쟁하는 조직으로만 남을 것인가, 아니면 공동의 목표를 위해 협력과 조화를 이루는 새로운 거버넌스를 만들어낼 것인가. 금융 범죄와 민생 범죄에서 전문성과 법집행의 연속성을 어떻게 확보할 것인가. 그리고 새로운 제도에서 발생하는 실패와 갈등을 어떻게 제도 개선과 성공의 자산으로 전환할 것인가.

이 질문에 답하는 과정에서 애덤 스미스의 도덕감정론은 새삼 중요한 통찰을 제공한다.

애덤 스미스가 말한 공감은 자신의 입장에서 벗어나 다른 사람의 처지에 자신을 놓아보는 능력이며 이를 통해 사회 구성원들이 공유할 수 있는 규범과 질서가 형성되는 과정이다. 가상의 공평한 관찰자는 바로 이러한 공감의 질서를 내면화하는 장치다.

검찰 개혁에도 공감의 질서가 필요하다. 수사기관은 기소기관의 입장에서 생각하고 기소기관은 수사기관의 입장에서 생각해야 한다. 법원 역시 새로운 제도에서 발생할 수 있는 현실 문제를 공감의 능력으로 함께 바라볼 필요가 있다. 그리고 무엇보다 제도의 중심에는 기관의 권한이 아니라 국민의 권리와 법치라는 공동의 목표가 놓여 있어야 한다. 지금 우리에게 필요한 것은 새로운 권력기관을 만드는 일보다 새로운 공감의 룰을 만드는 일이다. 검찰 개혁의 진정한 성패는 현판이 무엇으로 바뀌었는가에 의해 결정되지 않을 것이다. 전산망이 어떻게 바뀌었는가에 의해서도 결정되지 않을 것이다. 각 기관이 서로 다른 인센티브를 가지고 움직이면서도 어떻게 국민의 권리와 법치라는 공동 목표를 달성할 수 있도록 공감의 룰이 설계되는가에 의해 결정될 것이다.

그래서 2026년 10월은 검찰 개혁의 완성이 아니라 새로운 제도 설계의 출발점이어야 한다. 로버트 프로스트의 '가지 않은 길'(The Road Not Taken)처럼, 우리가 아직 걷지 않은 개혁의 길을 모색해야 할 때다. 그 길은 과거의 제도를 단순히 부정하는 데 그쳐서는 안 된다. 국가권력을 견제하고 적법절차와 개인의 권리를 지키며, 기관 간 협력과 서로 다른 입장을 존중하는 공통의 규칙을 세우는 길이어야 한다. 이것이 자유주의의 가치에 충실한 개혁인지 함께 성찰해야 할 가을이다.

 



[Reading Finance & Economy with Cho, Hong Kyoon] Criminal Justice Reform Must Be Addressed Through Incentive Design]

On October 1, 2026, I was visiting a district prosecutors' office in Seoul. With the government's criminal justice reform scheduled to take effect the following day, a news organization was there to cover the moment when the sign of the district prosecutors' office was replaced with that of the new name. In the afternoon, work also began to replace the prosecution service's entire computer network. The faces of the prosecutors and staff were visibly somber. It was clearly a moment that marked a major turning point in the 78-year history of the Korean prosecution service, established in 1948. The people at the court next door did not look particularly cheerful either. I found myself wondering whether what Adam Smith called an imaginary change of situation might be an expression of the human capacity for sympathy.

Justice is the main pillar that upholds the whole edifice of society. If this pillar is removed, the great, the immense fabric of human society … must in a moment crumble into atoms. This is what Adam Smith said in The Theory of Moral Sentiments. It struck me that changing a sign or replacing a computer network should not become a change to one of the pillars that sustain the edifice of society without stopping at an organizational change. I was reminded of the supposed impartial spectator within the human mind and the principle of an order based on sympathy that this spectator helps create. Perhaps the thought came to me because one of the questions I had set for last month's doctoral comprehensive examination had been on Adam Smith's The Theory of Moral Sentiments.

Looking back, over the past 78 years the Korean prosecution service has exercised extensive powers of criminal investigation and prosecution. It has, on the one hand, been an object of fear and criticism, but on the other, it has also been an institution associated with social recognition and respect. The reputation of prosecutors in Korean society was, in part, cultural in nature. Becoming a prosecutor meant not only bringing pride to one's parents but also obtaining a position endowed with power and becoming a state-certified elite.

Amid considerable controversy, the prosecution service has now entered a new system in which investigative and prosecutorial functions are separated. This may be viewed as a victory for hardline reformers who have argued that the prosecution service, by monopolizing both investigation and prosecution, had used politically motivated prosecutions to suppress and eliminate political opponents.

On the other hand, concerns have been raised that the reform could create gaps in the rule of law in a range of areas, including financial crime and crimes affecting people's livelihoods. These concerns have become particularly tangible with the dismantling of the financial and securities crime unit of the Seoul Southern District Prosecutors' Office, once known as the Grim Reaper of Yeouido. It may take considerable time for the new investigative agency that replace it to develop expertise and institutional know-how in so-called white-collar crime.

Financial crime investigations are fundamentally different from ordinary criminal investigations. Investigators must understand complex financial transactions, read the decision-making processes of capital markets and corporations, and continually adapt investigative techniques as new financial products and trading practices emerge. Without accumulated expertise and experience, statutory authority alone cannot guarantee effective law enforcement.

Firm law enforcement against financial crime played a crucial role in New York's development into a global financial hub. The Manhattan and Southern District Prosecutions, in particular, contributed to enhancing transparency and legal predictability in financial markets by consistently investigating and prosecuting sophisticated financial crimes, including insider trading, the target of regulations such as Rule 10b-5, which garnered significant attention with its enactment reported in the May 22, 1942 issue of The New York Times. By eradicating financial crime over decades through outstanding investigative capabilities and a strong will to enforce the law, the transparency and stability of the New York financial markets were significantly improved, leading to the establishment of solid trust at the highest global level. This is the reason why investment capital and financial professionals from around the world flock to the New York financial markets today.

There are many conditions necessary for financial development, but one of the core, and indispensable, is firmly establishing the rule of law in finance. This is because the essence of finance is trust, and the foundation of that trust originates from and is built upon the rule of law. Investors do not enter a market based solely on the prospect of high returns. They also ask whether contracts will be enforced, whether fraud and insider trading will be detected, whether unfair trading practices will be punished, and whether the law will be applied consistently rather than selectively to particular individuals or groups. The competitiveness of a financial market is determined not only by its financial systems and products, but also by the credibility of its law enforcement. Given that Korea has not yet achieved its goal of becoming a financial hub in Asia, strengthening the rule of law in the financial sector is all the more important.

The question, then, is how to address concerns that the separation of investigative and prosecutorial functions, introduced in response to criticism of politically motivated prosecutions, could create gaps in the rule of law in financial crime and other areas affecting citizens' livelihoods.

I believe the answer should be found in designing incentive structures based on law and economics. Now that investigative and prosecution agencies have been separated, the key issue going forward is designing a system that ensures the agencies cooperate effectively. Merely demanding cooperation is not enough. This is because emphasizing the necessity of cooperation is a completely different matter from actually making it happen.

What is needed is not merely consultation or coordination, but governance reform based on incentive alignment. The separation of investigative and prosecutorial functions will inevitably create a new zone of twilight between the agencies. Numerous boundary questions will arise: Which agency should be responsible for what? Who should set priorities among cases? How should information obtained during investigations be shared? And when a failure in prosecutorial decision-making occurs, to whom should responsibility be assigned?

What is required here is the simultaneous design of institutional frameworks for cooperation goals, cooperation performance indicators, cooperation accountability structures, and the conversion of failure into organizational learning. When inter-agency cooperation is lacking, it is generally not due to a lack of will. Rather, if the rewards for cooperation are meager, failure only increases liability, and success is not properly reflected in an agency's evaluation or personnel management, a rational organization will have an incentive not to cooperate.

Therefore, cooperation should not be left solely to the good faith of individuals. The cooperation process must be reflected in the performance evaluations of each agency, and the outcomes of investigations and prosecutions must be linked to personnel and compensation systems. Conversely, when failure occurs, responsibility should not be assigned based solely on the results, but rather rationally distributed according to each agency's controllability and decision-making processes. Particularly important is the mechanism for transforming failure into learning. Unexpected failures may arise after a new system is introduced. The key is how those failures are utilized as information for future success.

From this perspective, criminal justice reform cannot be approached adequately through legal formalism alone. It requires the combined perspectives of legal realism, which focuses on how law actually operates in society, and law-and-economics thinking. The focus should not remain on changing agency names or separating powers; it should extend to an analysis of the incentives facing actual actors and how those incentives shape their behavior. Law is not merely a set of rules written on paper. It is implemented through the behavior of those who act under it. The rule of law is not completed by the existence of law alone; it is realized in practice through the behavior and incentive structures of those who enforce it.

A good system is not one that presupposes good people. It is a system that produces socially desirable outcomes, even while considering differing interests and organizational incentives. This current reform of the prosecution system does not end with a single, all-out change; rather, what follows is what is truly important. Will investigative and prosecution agencies remain merely competing organizations, or will they create a new governance structure that fosters cooperation and harmony for common goals? How will expertise and continuity of law enforcement be secured in the areas of financial and public welfare crimes? Furthermore, how will the failures and conflicts arising from the new system be transformed into assets for institutional improvement and success?

In seeking answers to these questions, Adam Smith's The Theory of Moral Sentiments offers a remarkably relevant insight.

The sympathy Adam Smith described is the capacity to step outside one's own position and imagine oneself in another person's circumstances. Through this process, shared norms and social order can emerge. The supposed impartial spectator serves as an internal mechanism through which this order of sympathy is cultivated and internalized.

Criminal justice reform also requires such an order of sympathy. Investigative agency must be capable of seeing matters from the perspective of prosecutorial agency, while prosecutorial agency must likewise understand the perspective of investigators. The courts, too, need to view the practical challenges that may emerge under the new institutional framework with a capacity for sympathy. Above all, the common goal of the people's rights and the rule of law must lie at the center of the system, rather than the authority of the agency itself. What we need now is not simply to create new agency of power, but to create a new rule of sympathy. The true success or failure of criminal justice reform will not be determined by what the new sign on the building says. Nor will it be determined by how the computer network has been replaced. It will be determined by whether a rule of sympathy can be designed so that agencies operating with different incentives can nevertheless achieve the shared goals of protecting citizens' rights and upholding the rule of law.

That is why October 2026 should mark not the completion of criminal justice reform, but the beginning of a new phase of institutional design. In the autumn of 2026, we have reached a moment when we should seek what might be called the genuinely liberal path, the road that Robert Frost evokes in The Road Not Taken. It is not a path that simply rejects the system of the past. Rather, it is a path toward strengthening the rule of law, fostering cooperation among agencies, and creating new rules of sympathy. This is the autumn in which we should once again reflect on what the genuinely liberal path we ought to take should be.
